User License Agreement for EmailArchitect Email Server

Evaluation License

This license applies to the evaluation-licensed version of EmailArchitect Email Server (EAS). If you have a standard-licensed, professional-licensed or enterprise-licensed version of EAS, see the corresponding section.

NOTICE TO USER
You should read the following terms and conditions carefully before installing this software. Be aware that your use, distribution, or installation of this copy of EAS indicates your acceptance of this License.

If you do not agree to any of the terms of this License, then do not install, distribute or use this copy of EAS.

GRANT OF LICENSE
For each successful evaluation license registration, a non-exclusive license is granted for a SINGLE company to use this software for evaluation purpose in a period of 30-day without charge. If you continue using this software after the 30-day period, you are required to register the product.

LIMITED WARRANTY
THIS SOFTWARE, AND ALL ACCOMPANYING FILES, DATA AND MATERIALS, ARE DISTRIBUTED "AS IS" AND WITH NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THE USER MUST ASSUME THE ENTIRE RISK OF USING THE SOFTWARE. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THE AGREEMENT.

ANY LIABILITY OF ADMINSYSTEM WILL BE LIMITED EXCLUSIVELY TO REFUND OF PURCHASE PRICE. IN ADDITION, IN NO EVENT SHALL ADMINSYSTEM, OR ITS PRINCIPALS, SHAREHOLDERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, SUBSIDIARIES, OR PARENT ORGANIZATIONS, BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER RELATING TO THE USE OF EAS, OR YOUR RELATIONSHIP WITH ADS.

IN ADDITION, IN NO EVENT DOES ADMINSYSTEM AUTHORIZE YOU TO USE EAS IN APPLICATIONS OR SYSTEMS WHERE EAS'S FAILURE TO PERFORM CAN REASONABLY BE EXPECTED TO RESULT IN A SIGNIFICANT PHYSICAL INJURY, OR IN LOSS OF LIFE. ANY SUCH USE BY YOU IS ENTIRELY AT YOUR OWN RISK, AND YOU AGREE TO HOLD EAS HARMLESS FROM ANY CLAIMS OR LOSSES RELATING TO SUCH UNAUTHORIZED USE.

PROPRIETARY RIGHTS
This Agreement is the complete statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by the laws of Hong Kong. Exclusive jurisdiction and venue for all matters relating to this Agreement shall be in courts located in Hong Kong, and you consent to such jurisdiction and venue.

RESTRICTIONS
All rights of any kind in EAS which are not expressly granted in this license are entirely and exclusively reserved to and by Adminsystem. You may not rent, lease, modify, translate, reverse engineer, decompile and disassemble based on EAS. There are no third party beneficiaries of any promises, obligations or representations made by Adminsystem herein.

Standard License

This license applies to the standard-licensed version of EmailArchitect Email Server (EAS). If you have a professional-licensed, enterprise-licensed or evaluation version of EAS, see the corresponding section.

NOTICE TO USER
You should read the following terms and conditions carefully before installing this software. Be aware that your use, distribution, or installation of this copy of EAS indicates your acceptance of this License.

If you do not agree to any of the terms of this License, then do not install, distribute or use this copy of EAS. If you paid Adminsystem Software Limited (Adminsystem) or an authorized Adminsystem distributor for this copy individually, you may return it unused, within thirty (30) days after purchase, for a full refund of your payment.

For each successful standard license registration, a non-exclusive license was granted for a SINGLE company to use EAS on one server.
The licensee can use the software for 1 domain and 20 users.

LIMITED WARRANTY
THIS SOFTWARE, AND ALL ACCOMPANYING FILES, DATA AND MATERIALS, ARE DISTRIBUTED "AS IS" AND WITH NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THE USER MUST ASSUME THE ENTIRE RISK OF USING THE SOFTWARE. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THE AGREEMENT.

THIS SOFTWARE, AND ALL ACCOMPANYING FILES, DATA AND MATERIALS, ARE DISTRIBUTED "AS IS" AND WITH NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THE USER MUST ASSUME THE ENTIRE RISK OF USING THE SOFTWARE. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THE AGREEMENT.
